The above said POODLE, TOY is sold as a PET ____ SHOW PROSPECT ____ for the total price of $_________. A deposit of $_________ ($300 minimum) is hereby made and the cash balance is due to the SELLER before this dog is placed in the BUYER’S possession. Registration papers will also be held until the balance is paid in full. The BUYER understands that once a deposit is made, it is a commitment to buy said dog and is therefore NON-REFUNDABLE. BUYER will forfeit deposit and said dog will be re-sold if not paid in full by specified date being _______________.
IT IS HEREBY AGREED BY PARTIES THAT THE FOLLOWING CONDITIONS WILL BE MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE EXPRESSED OR IMPLIED.
If this dog has been classified as a PET by SELLER, it does not qualify as a Show Prospect/Show Quality dog at this time of sale. This dog is being sold with a FULL ____ LIMITED ____ registration.
SELLER guarantees this is a purebred POODLE, TOY, offspring of the previously mentioned Sire and Dam.
BUYER certifies that s/he is not acting as an agent for another individual in the purchase of this dog, and will not sell this dog to any mass-producing kennel (puppy mill) or business.
The purchaser promises to keep the dog in a proper manner. It shall not be kept permanently in a kennel. If problems arise concerning keeping or training, or if the dog becomes seriously ill, the BUYER agrees to consult the BREEDER. If, for any reason, the dog cannot be cared for by PURCHASER, the dog shall be returned to the BREEDER. This puppy has been bred by us and has been carefully and painstakingly reared. The parent animals were mated with the aim of breeding good and healthy puppies. Seller guarantees this dog to be freed of communicable diseases as appears to the eye at the time of sale.
At the expense of the BUYER, this dog should be examined by a licensed veterinarian within 48 hours of possession to validate Heath Guarantee. (If purchased on a Saturday, this requirement is extended through the following Monday.) Should this dog be found in ill health, the cause of which is clearly attributable to the BREEDER, this dog may, upon written diagnosis from a veterinarian, be returned to SELLER for a refund of purchase price or for another dog of equal value, the choice to be determined by SELLER. If any genetic conditions should arise within the dogs life time, a full refund will be provided.
No other warranties are expressed or implied unless explained by SELLER below:
In the case of a puppy being sold as a pet, the new owner will provide proof of spay/neuter by the age of six months. Where then SELLER will turn over registration documents and full AKC ownership.
BUYER releases SELLER, ANNA BAKER, and their estate from any and all liabilities, and/or damages by fault of this dog after time of sale. These damages include, but are not limited to, destruction of property and/or physical damage to any person or group of people.
This contract is made out in duplicate; the SELLER and the BUYER each receive one copy.
